Emanuel Westfall Jr.

Emanuel Westfall Jr. (1862-1923) was my father's uncle, the son of Emanuel Westfall Sr. and Hannah (Kelley) Westfall, and the only brother of my grandfather Jasper Mifflin Westfall. His father, My great grandfather Emanuel Westfall Sr. (1828-1863) was killed while plowing during the Civil War in 1863 in West Virginia. I don't know the circumstances. He may have been killed by some kind of military action. The Civil War was raging in Virginia at the time, and the state was divided by warring factions. In 1861 West Virginia had split off to become a separate state. It entered the Union in 1863.

After my great grandfather's death his wife Hannah (Kelley) Westfall (1837-1918) moved with her 2 sons (my grandfather Jasper who was only 6 and his one year old brother Emanuel Jr.) to near Bloomington, McLean County, IL. She may have had relatives in the area. She and her youngest son Emanuel Westfall Jr. stayed in Bloomington, McLean County, IL after her oldest son, my grandfather, Jasper Mifflin Westfall and his first wife Mary Jane Shannon and her parents had moved on to Kansas in 1878. My father's uncle Emanuel Westfall Jr. married and remained in the Bloomington, McLean County, Illinois area, and farmed and raised his family there.

Emanuel Westfall Jr.

Emanuel Westfall Jr. was my father's uncle, the son of Emanuel Westfall Sr. and Hannah (Kelley) Westfall, and the only brother of my grandfather Jasper Mifflin Westfall. He was born 4-9-1862 near Roanoke, Lewis County, West Virginia. He died 9-28-1923 in Gibson City, Ford County, IL. He married Margaret Towsely, the daughter of John and Esther (Morgan) Towsely. He wed Margaret Tousley in Livingston County, Illinois on May 20, 1891. They lived in Saybrook, McLean County, Illinois and later in Ford County, Illinois. Both her parents were born in Illinois. She was born 8-2-1869 in Saybrook, McLean County, IL. She died 4-12-1922 in Gibson City, Ford County, IL. Emanuel and Margaret are buried in Saybrook, Illinois but don't know which of the two cemeteries there. Emanuel Westfall Jr. and Margaret (Towsely) Westfall had 11 children-Stella L. Westfall born in Dec 1891; Orville C. Westfall born on 22 Oct 1893; Roy Elwood Westfall born on 10 Jan 1898; Ottie Dell Westfall born in 1902; Harley Westfall; Bessie J. Westfall born in 1904; Earl Westfall; Cora May Westfall born in 1908; Artie M. Westfall born in 1910; Nora Westfall; and Marie Westfall.

(1) Emanuel and Margaret (Towsely) Westfall's daughter Stella Westfall born 12-8-1891 married Sanders Wright in 1907. He was born 3-29-1885 and died in 1945. After his death Stella married Steven Beigel in 1947. Sanders and Stella (Westfall) Wright had 7 children-Raymond, Wesley, Frank, Helen, Ellen, Alice, and Florence.

(1a) Sanders and Stella (Westfall) Wright's son Raymond Wright was born 2-6-1909. He had 2 children, Doris Mae Wright, and Carl Delmar Wright. The name of his wife not known.

He married Eina Schwark in 1919 in Kamkakee, IL. She was born 4-1-190, the daughter of John and Josephine (Hoffman) Schwark. Orville and Eina had no children. Eina later married Wallace Prince.

(3) Emanuel and Margaret (Towsely) Westfall's son Roy Elwood Westfall born 1-10-1898 in Chaneys Grove Township, McLean County, IL. He died 11-9-1965. He married Ruby Estella Thornton in 1924, the daughter of Thomas and Lena (Miller) Thornton. They had 2 children-Donald Elwood Westfall and James Orville Westfall.

(2a) Roy and Ruby (Thornton) Westfall's son James Orville Westfall born 3-19-1927 in IL, died 4-22-1971 in Nashville, Tenn. in a car wreck. He married Shirley Regnier in 1948 in Kankakee, IL, the daugher of Paul and Marie (Landry Regnier. James Orville Westfall and Shirley (Regnier) Westfall had 2 children-Darrell James Westfall and Cynthia Ann Westfall.

(1aa) James and Shirley (Regnier) Westfall's son Darrell James Westfall was born 6-21-1949. He married Monica Scurrah born 9-10-1951 in Peoria, IL, the daughter of Melvin Scurrah. They had a son Michael James Westfall born 7-24-1971.

(2aa) James and Shirley (Regnier) Westfall's daughter Cynthia Ann Westfall was born 5-5-1951. She married Richard Sleiga first, and her second husband was Roger Kieger. She had a son Richard Sleiga born 6-14-1969.

(4) Emanuel and Margaret (Towsely) Westfall's daughter Ottie Westfall born 6-22-1901 married Raymond Parker. She died 7-27-1965 in Gibson City, IL. Ottie and Raymond Parker had no children.

(5) Emanuel and Margaret (Towsely) Westfall's son Harley Westfall born 3-28-1903, died 3-30-1903. He died as a baby 2 days old.

(6) Emanuel and Margaret (Towsely) Westfall's daughter Bessie Westfall was born 6-17-1904 in Gibson City, IL. She died 2-7-1969. Bessie had a son Orville Westfall who married Mildred Roman in 1952, the daughter of Joseph Roman of Chicago, IL. Orville and Mildred (Roman) Westfall had 3 children-Joseph Westfall born 8-4-1954, Michael Westfall born 12-16-1955, and Jacquline Westfall born 12-25-1956.

(7) Emanuel and Margaret (Towsely) Westfall's son Earl Westfall born 12-28-1906, died 1-20-1907 in Gibson City, IL.

Emanuel and Margaret (Towsely) Westfall's twin daughters (8) Cora Westfall and (9) Nora Westfall were born 1-24-1908. Nora died at birth. Cora died 8-1-1951 in Kankakee, IL. Cora was married to Lawrence McFarland born 7-28-1903. He died 9-15-1969 in Kankakee, IL. They had no children.

Asbury P. Westfall

I have some information about Asbury P. Westfall's family. He was a brother to my great grandfather Emanuel B. Westfall (1828-1863). Asbury P. Westfall was born in 1830 in Lewis County, West Virginia, the son of My great great grandparents Jacob C. Westfall (1797-1860) and Elizabeth Runyon (Smith) Westfall born (1799-?). They had 11 children--my great grandfather Emanuel B. Westfall (1828-1863-married Hannah Kelley in 1856), Asbury P. Westfall (1830-1904-married Sarah Elizabeth Cottrell), Granville Westfall born 1835, William Westfall born 1837, Perry Westfall (1840-1907-married Elizabeth Reynolds), Merinda (or Marinda) J. Westfall born 1842 married Samuel Cottrell 3-10-1864 in Roane Co, WVA, Catherine Westfall (born 1820-1825-married John Jack in 1841), John C. Westfall (born 1819 married Elizabeth Parker born 1818, maiden name unknown, and their children were-Rebecca A. Westfall, Dorinda J. Westfall, Martha E. Asbury P. Westfall died 9-4-1904 in Roane County, West Virginia. Asbury is last shown in the 1900 census for Roane County. Asbury Westfall married Sarah Elizabeth Cottrell on 14 Mar 1871 in Roane County, WV. Sarah Elizabeth Cottrell was born in 1841, the daughter of Andrew (born 1815) and Maria (Waggoner) Cottrell (1818-1905), and they had 4 sons-Samuel Westfall born Apr 1872, died 1938; Andrew J. Westfall born 30 Jul 1869; John Wesley Westfall born in Feb. 1868, died 1941; and Alexander Westfall born 23 Oct 1874, died 1932.

Elza Oris Westfall's obituary - The Times Record - October 8, 2009 - Elza O. Westfall, 91, of Spencer, died Friday, Oct. 2, 2009 at his home. He was born in Roane County, the son of the late John and Verna Boggs Westfall. He was a farmer and attended Mt. Olive Baptist Church. He is survived by his wife of 68 years, Dorothy Nichols Westfall; three daughters, Nancy Elliott, Sue Peffer and Barbara Smith, all of Spencer; two sons, Frank and Ken Westfall, both of Spencer; two sisters, Thelma Guthrie and Golda Milhoan, both of Akron, Ohio; nine grandchildren and 12 great-grandchildren. In addition to his parents, he was preceded in death by a brother, Charles Westfall; a sister, Bertha Slaughter; and a grandson. Service was Sunday at Taylor-Vandale Funeral Home with Rev. Charles Davis and Rev. Phillip Lawrence officiating. Burial was in Mt. Olive Cemetery, Reedyville Road.

Dorothy Nichols Westfall's obituary - September 30, 2014 - Parkersburg News and Sentinel - Dorothy Nichols Westfall, 96, of Spencer, W.Va., passed away on Monday, Sept. 29, 2014, at the Roane General Hospital in Spencer. Services will be at 1 p.m. on Thursday, Oct. 2, at the Taylor-Vandale Funeral Home, Spencer. Visiting hours are from 6-8 p.m. Wednesday, Oct. 1, at the funeral home.

She married 2nd Edwin W. Hill. Wilma Grace (Westfall) Hutchinson Hill's obituary - Wilma Grace Hill, 83, of Lubeck, WV. passed away March 13, 2010 at her residence. She was born in Parkersburg on November 28, 1926 a daughter of the late Lonnie G. and Rachel B. Bowman Westfall. Wilma was a 40 years member of Lubeck United Methodist Church where she was a member of the church chior. She was a 50 years member of the Eastern Star and a lifetime member of the Grand Cross of Colors. Surviving are her children and their spouses, Craig and Sharon Hutchinson of Chesapeake, VA, Stephanie and Joseph Day of Washington, WV, Scott and Ruthie Hill of Hickory, NC, Denise and Rodney Starcher of Washington, WV, and Michael and Lisa Hill of Lubeck, WV, eight grandchildren and eight great-grandchildren. She was preceded in death by her parents, 1st husband, Kenneth C. Hutchinson, 2nd husband, Edwin W. Hill and a daughter, Melanie Hutchinson. Services will be Tuesday 1:PM at Lubeck United Methodist Church with Reverend Mark E. Parsons ll officiating. Burial will follow in Ravenswood Cemetery. Visitation Monday 2-4 & 6-8 PM at Leavitt Funeral Home, Parkersburg and Tuesday noon till 1PM at the church. (1aaa) Kenneth Charles Hutchinson and Wilma Grace (Westfall) Hutchinson Hill's daughter Melanie Ann Hutchinson's obituary - LUBECK, W.Va. Melanie Ann Hutchinson, 53, of Lubeck lost a short battle with cancer on Saturday (Dec. 10, 2005). She was born Dec. 5, 1952, in Charleston, W.Va., to the late Kenneth C. Hutchinson and Wilma Hutchinson Hill of Lubeck. She was employed at Marietta Memorial Hospital as a respiratory therapist, and had worked in this field since 1972. She had also worked at Roane General in Colorado Springs, and at St. Joseph's Hospital for many years. She is survived by her mother and father, Wilma and Edwin Hill of Lubeck; two sisters and their husbands, Stephanie and Joe Day and Denise and Rodney Starcher, all of Washington, W.Va.; three brothers and their wives, Craig and Sharon Hutchinson of Chesapeake, Va., Michael and Lisa Hill of Lubeck and Scott and Ruthie Hill of Hickory, N.C.; and many nieces and nephews. She is also survived by a special friend, Glen Linger of Lubeck, and many loving friends. Services will be at 3 p.m. Wednesday at Leavitt Funeral Home in Parkersburg with the Rev. Mark Smith officiating. Burial will be in Ravenswood Cemetery. Visitation will be from 2 to 4 and 6 to 8 p.m. Tuesday. Larry also worked for 7 years as a Security Guard at Mountain State Blue Cross and Blue Shield. He enjoyed wood crafting, working outdoors, writing, and had a great sense of humor. Larry wrote a book called “MY LIFE where have the years gone”, and a song “Jesus is my Rock”. He is survived by his wife, Teresa Lee (Sands) Westfall; one daughter, Delisa Westfall; two step-sons, Brian (Michelle) and Brad (Tina) McMullen; three sisters, Delores (Danny) Arauz, Darlene Parsons and Denise (Terry) Parsons; one brother, Wiley (Janet) Westfall; half- brother, Max (Carol) Westfall; two grandsons, Levi and Seth Westfall; six step-grandchildren, Justin, Ally, Garret, Lilly, Rylie and Ella McMullen; two step-great grandsons, Jacob and Gavin McMullen. In addition to his parents he was preceded in death by his step-father, Doral Dye; his first wife, Myra Westfall; brother, Harold Westfall; and brother-in-law, J.R. Parsons. Funeral services for Larry will be at 11:00 A.M., Monday, October 1, 2018 at Lambert-Tatman Funeral Home, Vienna, WV with Pastor David Carrico officiating. He lived in Atwater most his life where he worked at Lamb Electric for 42 years, and was a member of the Lake Milton Fish and Game Club. Survivors include his wife of 68 years, Maxine (Hubbard) Westfall, sons, Gerald (Jane) Westfall of Atwater, Wayne (Joyce) Westfall of Alliance, Rickey (Rita) Westfall of Atwater, Larry Westfall of Deerfield, sister, Eleanor Barger of Columbus, 5 grandchildren, 8 great grandchildren, and 1 great great grandchild. Besides his parents he was preceded by 1 sister and 5 brothers. Cremation has taken place and a graveside service will be held later in the spring in the Atwater Cemetery. "The Westfall Act"
Rodney Preston Westfall's name was given to a law called the Westfall Act.

Rodney Preston Westfall was the chief of the Receiving Section at the Anniston Army Depot in Anniston, Alabama. He and Osburn Rutledge, the chief of the Breakdown and Bulk Delivery Unit, and William Bell, the chief of Unloading Unit No. 1 were sued by William T. Erwin, Sr., who was employed by the federal government as a civilian warehouseman at the Anniston Army Depot in Anniston, Alabama. He asserts that he was injured on February 9, 1984, when he "picked up a bag of soda ash and inhaled some of the soda ash dust that had spilled from the bag" (Erwin Affidavit filed June 4, 1985, at 1). He claims that as a result of his contact with the soda ash he sustained chemical burns in his eyes and throat that caused permanent injury to his vocal chords and impairment of his ability to speak (ibid.; Complaint at 4). William Erwin and his wife, respondent Emely Erwin, subsequently commenced this action in Alabama state court. The complaint alleged that "bags or containers of soda ash were improperly and negligently stored at (William Erwin's) workplace," that "such bags or containers were negligently designed or manufactured or alternatively, that the manufacturers or distributors of such bags issued inadequate warnings concerning their use and storage" (Complaint at 3). William Erwin stated in a subsequently filed affidavit that "(t)he soda ash that I inhaled was improperly stored and should not have been routed to the warehouse where I was working. The court case went all the way to the United States Supreme Court. The Supreme Court's decision in Westfall v. Erwin, 484 U.S. 292 (1988) limited a federal official's absolute immunity from tort claims to situations where the official's actions were "within the outer perimeter of an official's duties and . . . discretionary in nature." The US Congress saw this as an erosion of the common law tort immunity formerly available to federal employees and so the Westfall Act "was rushed into law in 1988 to avoid what was expected to be a crisis in exposing federal workers to court suits". Notably used to avoid the charge that the Iraq war is illegal, so something of a carte blanche for US government employees whom the legal system wishes to defend. The Federal Employees Liability Reform and Tort Compensation Act of 1988, (Westfall Act), 28 U.S.C. § 2679, amended the Federal Tort Claims Act to provide for the substitution of the United States as a defendant in any action where one of its employees is sued for damages as a result of an alleged common law tort committed by the employee within the scope of his or her employment. Origins The United States Supreme Court's decision in Westfall v. Erwin, 484 U.S. 292 (1988) limited a federal official's absolute immunity from tort claims to situations where the official's actions were "within the outer perimeter of an official's duties and . . . discretionary in nature." The US Congress saw this as an erosion of the common law tort immunity formerly available to federal employees and so the Westfall Act "was rushed into law in 1988 to avoid what was expected to be a crisis in exposing federal workers to court suits".[1] Citations The United States Department of Justice cited this act in the case of Saleh v. Bush, avoiding the need to rule on whether the Iraq War was a premeditated war of aggression, by claiming that the court had no "subject-matter jurisdiction" since George Bush et al. were "Government employees [acting] in the scope of their employment".[2] A 2016 appeal was rejected in February 2017 by 3-0, with Judge Susan Graber stating that "What took place in the late 1990s was not planning, but only advocacy.

Petitioner Rodney P. (William Erwin was reimbursed under the FECA for his medical costs and received disability pay for the period that he was unable to work. He did not receive compensation for the alleged permanent harm to his vocal chords on the ground that the FECA does not authorize compensation for that injury.)

Petitioners, three federal employees who are supervisors at the Anniston Depot, are named as defendants in the complaint. /1/ The complaint also lists as defendants 21 unnamed individuals or entities (Complaint at 1-3). William Erwin seeks damages in the amount of $500,000; Emely Erwin seeks $25,000 in damages for loss of consortium (id, at 4, 5). Petitioners removed the action to the United States District Court for the Northern District of Alabama pursuant to 28 U.S.C. 1442(a) (1); they filed a motion to dismiss or, in the alternative for summary judgment on the ground that they were absolutely immune from suit. Respondents opposed the motion, asserting that a federal employee is entitled to immunity from tort liability only if the employee is engaged in policymaking activities. William Erwin filed an affidavit stating that petitioners "are not involved in any policy-making work for the United States Government. Their job duties are similar to mine, with the addition of their supervisory responsibilities. Therefore, (i)t is my understanding that their duties only require them to follow established procedures and guidelines. We all work at the operational level of the United States Government and are not at the policy and planning level" (Erwin Affidavit at 2). The district court granted the motion and dismissed the action against petitioners (App., infra 4a-7a). The court first observed that petitioners' motion was accompanied by an affidavit stating that they were "acting under color of their office and within the scope of their official duties at the time of the acts or omissions made the basis of" respondents' tort claims; the court noted that respondents did not dispute those facts (id. at 5a). Relying upon Johns v. Pettibone Corp., 755 F.2d 1484 (11th Cir. 1985), the district court stated that "(t)he law of the Eleventh Circuit is clear that * * * any federal employee is entitled to absolute immunity for ordinary torts committed within the scope of their jobs"; it held that petitioners accordingly were "absolutely immune from suit on account of the matters alleged in the complaint" (id. at 5a). 2. The court of appeals reversed (App., infra, 1a-3a). It observed that "the opinion (in Johns v. Pettibone Corp., supra) relied on by the district court was subsequently withdrawn" (id. at 2a). The revised opinion "establishes the rule that 'a government employee enjoys immunity only if the challenged conduct is a discretionary act and is within the outer perimeter of the actor's line of duty'" (id. at 3a, quoting Johns v. Pettibone Corp., 769 F.2d 724, 728 (11th Cir. 1985) (emphasis in original; citation omitted)). The court of appeals stated that the district court in the present case "erred as a matter of law in applying only one part of the immunity test -- whether the act was in the scope of the employees' duties -- without determining whether the challenged conduct was or was not discretionary" (App., infra, 3a). Finding that respondents had "alleged undisputed facts sufficient to create a material question of whether or not (petitioners') complained-of acts were discretionary," the court reversed the grant of summary judgment and remanded the action for further proceedings (ibid.). The award was commemorated on a handsome plaque and presented to him by a large group of his dear colleagues who met at his home in celebration of his service, life and friendship. Randall was duly proud, too, of his service in other venues, notably local law enforcement and US Military. He retired from active duty as a Captain with the Anniston Police Department in 1999. He has been honored as an original member of the department's elite Special Response Team. Randall received an Honorable Discharge from the US Army in 1979 after serving his country as a Paratrooper with the 101st Airborne Division. He was decorated with the National Defense Service Medal, Parachutist's Badge and Sharpshooter Badge with a Rifle Bar and the Good Conduct Medal. Randall was an avid motorcycle rider and a prospector, panning for gold in the style of the Old American West in such places as Nome, Alaska. His schnauzer dog "Izzie" remained close to him throughout his illness.
